These Terms & Conditions ("Terms") govern your access to and use of the Telvoip website, communication platform, and related services ("Services") offered by Telvoip. By creating an account, using the Services, or continuing to use the website after we post changes, you agree to these Terms.
Services
Telvoip provides cloud-based contact centre and communication capabilities as described on our website and in your order or subscription. Features may change over time; we may add, modify, or discontinue functionality with reasonable notice where practicable.
Accounts and eligibility
You must provide accurate registration information and keep it current. You are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use. You must have authority to bind your organization if you register on its behalf.
Acceptable use
You agree not to:
- Use the Services in violation of law or third-party rights
- Transmit unlawful, harassing, fraudulent, or harmful content
- Attempt to probe, scan, or test the vulnerability of our systems without authorization
- Interfere with or disrupt the Services or other users
- Reverse engineer or attempt to extract source code except where applicable law permits
Fees
Paid Services are subject to the fees and billing terms shown at checkout, in your agreement, or on our pricing page. Failure to pay may result in suspension or termination of access.
Intellectual property
Telvoip and its licensors own all rights in the Services, software, branding, and documentation. We grant you a limited, non-exclusive right to use the Services during your subscription in line with these Terms. You retain rights in your own content; you grant Telvoip the rights reasonably needed to operate and improve the Services for you.
Privacy
Our collection and use of personal data is described in the Privacy Policy, which is incorporated by reference.
Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELVOIP DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELVOIP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID TO TELVOIP FOR THE SERVICES IN THAT PERIOD (OR, IF NONE, TO ONE HUNDRED U.S. DOLLARS), EXCEPT WHERE LAW DOES NOT ALLOW SUCH A CAP.
Indemnity
You will defend and indemnify Telvoip and its affiliates, officers, and employees against claims arising from your use of the Services, your content, or your breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.
Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment, legal requirements, or risk to the Services or others. You may stop using the Services at any time. Provisions that by nature should survive (including disclaimers, limitations, and indemnity) survive termination.
Governing law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply.
Changes
We may modify these Terms by posting an updated version on this site. Material changes may be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.
